The Hazardous waste regulations enacted by the Environmental Protection Agency (EPA) in the late 1970s have always provided challenges for healthcare. The rules were written for the industry with several major waste streams whereas healthcare has multiple smaller waste streams from multiple departments.

The updated EPA rules create regulations that are a better fit for the healthcare sector. The rules eliminate the intentional sewering of hazardous waste pharmaceuticals by all covered/newly defined “healthcare entities,” including among others, medical clinics, long term care facilities, ambulance services, retail pharmacies, dental, chiropractic clinics, and veterinary clinics/hospitals.

The rules reduce overlapping regulations (e.g., Drug Enforcement Agency (DEA), Food and Drug Administration (FDA). The goal is to provide regulatory clarity and national consistency on how the Resource Conservation Recovery Act (RCRA) applies to reverse distribution and reverse logistics. Sub Part P of the EPA rule will provide regulatory relief to healthcare facilities that are strictly regulated as large quantity generators even when generating small amounts of nicotine replacement therapies.
